Jasmine Shams is an associate in the Newport Beach office of Newmeyer Dillion whose practice focuses primarily in labor and employment law.

Jasmine advises businesses on a wide range of labor and employment issues, including general practices, termination and disciplinary decisions, wage and hour issues, and compliance with the NLRA, ALRA, Title VII, FEHA, the FMLA, the FLSA, OSHA and other federal, state, and local laws. She is a frequent speaker on litigation avoidance, labor and employment trends, and sexual harassment and discrimination prevention.  Jasmine’s analytical approach of her clients’ business and legal needs allows her to develop and implement practical solutions to complex legal issues.

Labor

Jasmine represents both unionized and non-unionized employers before the National Labor Relations Board and the Agricultural Labor Relations Board.

Jasmine’s experience includes:

  • Representing the decertification petitioner in the longest hearing before the ALRB.
  • Representing employers in union organizing campaigns before the NLRB and the ALRB.
  • Successfully defending employers in unfair labor practice charges before the NLRB and ALRB.

Employment

Jasmine has experience defending companies throughout all stages of litigation before federal courts, state courts, and administrative agencies.  These claims include:

  • wrongful termination,
  • harassment,
  • discrimination and retaliation,
  • prevailing wage liability,
  • Cal/OSHA citation appeals,
  • alter ego/single employer liability, and joint employer liability, and
  • wage and hour class and collective actions.

In addition, she frequently assists clients with the development of policies, employee handbooks and separation agreements. She also conducts workplace investigations, wage and hour audits, and employee trainings.

Some of Jasmine’s most recent experience includes:

  • Successfully defending a staffing agency in a harassment and retaliation claim before the Department of Fair Employment and Housing, which resulted in a dismissal.
  • Defending several employers in numerous putative wage and hour class and PAGA actions, including cases alleging misclassification of workers, failure to pay overtime, failure to provide meal and rest breaks, failure to provide accurate wage statements, and failure to reimburse business expenses.
  • Representing an employer at a Labor Commissioner hearing, which resulted in a decision in favor of the employer.
